Your Terms of Service are comprehensive, but given the updates to your services (like The Creative Expedition and Serve the World), here are some additional clauses and adjustments to better reflect your offerings, protect your timelines, and manage revisions or add-ons effectively:
Additions and Revisions
1. Revisions Policy
Each package includes two rounds of revisions, which must be requested within the project timeline.
Revisions are defined as adjustments to the approved design direction, such as typography, color, or minor layout tweaks.
Major changes to the creative direction are only allowed during Week 1 of The Creative Expedition™ or as explicitly agreed upon. Any significant changes or additional revisions beyond the two included rounds will incur a fee of $90 AUD per revision.
Requests that exceed the agreed timeline or scope may require a separate Design Intensive or a new agreement.
2. Additional Products or SKUs
For The Creative Expedition™ or similar packaging projects, the package covers one primary packaging design and one SKU. Additional products or packaging variations can be accommodated through a separate Design Intensive or additional charges as agreed upon in advance.
3. Beta Pricing
For beta-phase offers, discounted pricing is limited to specified slots. Deliverables for beta projects are subject to the terms outlined in the package description and do not include additional revisions or services outside the agreed scope. Beta pricing offers are non-refundable.
4. Deliverable Ownership
Ownership of deliverables (e.g., final logos, packaging files, brand guides) transfers to the client upon receipt of full payment. All unused design concepts remain the property of Studio Deia unless otherwise agreed in writing. Studio Deia reserves the right to showcase the completed work in portfolios and promotional materials unless the client requests confidentiality in writing prior to project commencement.
5. Timeline and Client Responsibilities
Timely Feedback: Clients are responsible for providing feedback within the agreed timeframe. Delays caused by lack of communication may result in additional fees or timeline adjustments.
Extension Policy: If a project requires rescheduling due to client delays, a reactivation fee of 15% of the total project cost will apply.
Force Majeure: Studio Deia is not liable for delays caused by circumstances beyond our control (e.g., technical issues, illness, emergencies).
6. Payment for Emergency Revisions or Rush Work
Emergency revisions or changes requested outside regular timelines are subject to an additional fee of 25% of the project cost.
Studio Deia reserves the right to decline emergency work requests if it compromises existing project commitments.
7. Lead Magnets and Small Packages
For small introductory packages like the Explorer Package or Serve the World:
These packages are non-refundable and include specific deliverables as outlined.
Upgrades to more comprehensive packages must be requested before project completion. Adjusted timelines and additional fees may apply.
8. Collaboration with Third Parties
In instances where third-party services (e.g., Shopify development) are required, Studio Deia may recommend external collaborators. Studio Deia is not responsible for work completed by third parties or any associated delays or issues.
9. Confidentiality and Non-Disclosure
Studio Deia treats all client information and project details as confidential unless otherwise agreed upon for marketing purposes. Both parties agree to respect the privacy of shared materials during and after the project.
10. Refund Policy
Studio Deia does not offer refunds for services rendered. If a client is dissatisfied, efforts will be made to address concerns within the terms of the agreement. Refunds on deposits or completed work are not provided.
